Our General Terms and Conditions (GTC)

§ 1 Scope

These General Terms and Conditions (GTC) apply to all services provided by the Funck family (hereinafter referred to as “FUNCKYHOME”) to the guest, the organizer, or other contractual partners (hereinafter “Contractual Partner”). The services consist in particular of the paid provision of apartments, as well as all related additional services and deliveries by FUNCKYHOME. FUNCKYHOME is entitled to fulfill its services through third parties. These GTC refer to all types of contracts, such as hotel accommodation, package tour, contingent, or event contracts concluded with FUNCKYHOME. The GTC also apply to all future business with the Contractual Partner. GTC of the Contractual Partner do not apply, even if FUNCKYHOME does not expressly object to them. Counter-confirmations by the Contractual Partner referring to its GTC are hereby contradicted. By concluding the contract, the Contractual Partner confirms knowledge and acceptance of these GTC.

§ 2 Conclusion of contract

The respective contract is generally concluded following a verbal or written request by the Contractual Partner and acceptance by FUNCKYHOME. FUNCKYHOME is free to accept the request in writing, verbally, in text form (email), or implicitly through the provision of services. If the Contractual Partner concludes a so-called contingent contract, the Contractual Partner is liable for all damages caused culpably by the end user. Subletting or further subletting or the free use of the provided rooms by third parties, as well as use for purposes other than accommodation, is only permitted if FUNCKYHOME expressly allows it. FUNCKYHOME may, at its discretion, grant a written exception upon request.

§ 3 use of rooms

Room Handover, Departure, Smoking Ban, Pets, Parking The provision of rooms is exclusively for accommodation purposes. Pets are only permitted upon explicit request and prior written consent from FUNCKYHOME for a separate fee. For dogs, a leash requirement applies throughout the entire property and in the common areas of the building. The dog owner is obligated to completely remove dog waste and dispose of it in the outdoor trash bin; disposal in the apartment's household waste is not permitted. The Contractual Partner is liable for all damages caused by brought pets. The Contractual Partner is liable to FUNCKYHOME for all damages caused by them or by third parties who receive FUNCKYHOME's services at their instigation. The Contractual Partner has no claim to the use of specific rooms. If rooms in the building are not available, FUNCKYHOME will inform the Contractual Partner immediately and offer equivalent replacement in a nearby hotel of the same category. Booked rooms are available to the Contractual Partner on the arrival day from 4:00 PM. Arrival typically occurs between 4:00 PM and 7:00 PM. Delays must be reported in advance by phone. Arrivals after 10:00 PM may be rejected by FUNCKYHOME unless otherwise agreed. The Contractual Partner has no claim to earlier provision. Unless otherwise agreed, FUNCKYHOME has the right to assign booked rooms to others on the day following the planned arrival, without the Contractual Partner being able to derive any rights or claims from this. Rooms must be vacated on the departure day in high season by 10:30 AM at the latest, and in low season by 11:00 AM. Thereafter, FUNCKYHOME may charge, in addition to the resulting damage, 25% of the accommodation rate for additional use of the room until 1:30 PM, 80% from 3:00 PM, and 100% of the accommodation rate (daily rate) from 5:00 PM. There is no entitlement to a parking space. Parking spaces are provided free of charge if available, without FUNCKYHOME being liable for damages or theft. Smoking is prohibited in all apartments/rooms and in the hallways. In case of violation, the offending guest will be charged an extra cleaning fee of €500.00. In case of repeated violations, FUNCKYHOME may terminate the contract with the guest immediately. The guest will receive no refund. If a violation of this smoking ban makes further rental impossible due to persistent odor nuisance, FUNCKYHOME reserves the right to charge the offending guest in full for the revenue loss and additional cleaning costs, even after their departure.

§ 4 Provision of services, prices, payments, set-off and assignment

The prices for the respective services are determined by FUNCKYHOME's price list valid at the time of service provision. All prices include the currently applicable statutory value-added tax. Increases in value-added tax are borne by the Contractual Partner. If the period between contract conclusion and the first contract performance exceeds 120 days, FUNCKYHOME has the right to make price increases of up to a maximum of 15%. Subsequent changes to services may lead to price changes. FUNCKYHOME is entitled, upon conclusion of the contract, to demand an advance payment or security deposit from the Contractual Partner up to 100% of the Contractual Partner's total payment obligation. The amount of the advance payment and payment deadlines may be specified in the contract. Invoices are generally payable immediately in cash or via PayPal or bank transfer. FUNCKYHOME is entitled to reject foreign currencies, checks, and credit cards. Vouchers from tour operators are only accepted if a credit agreement exists with the relevant company or if corresponding advance payments have been made. Refunds for unused services are excluded. FUNCKYHOME's payment claim is due immediately upon receipt of the respective invoice without deduction. An invoice is deemed received by the invoice recipient at the latest 3 days after dispatch, unless earlier receipt can be proven. In case of payment default, FUNCKYHOME is entitled to demand the applicable statutory default interest. The preparation of a total invoice does not release from the timely payment of individual invoices. A payment default on even one individual invoice entitles FUNCKYHOME to withhold all further and future services and to make the fulfillment of services dependent on a security deposit of up to 100% of the outstanding payment. A reminder fee of €5.00 is due for each reminder. All further collection costs are borne by the Contractual Partner. The Contractual Partner may only set off against a claim by FUNCKYHOME if their claim is undisputed or legally established. The same applies to the exercise of a retention right due to the Contractual Partner's own claims. Claims and other rights may only be assigned with FUNCKYHOME's written consent. If the Contractual Partner uses a credit card for payment of hotel services with advance payment obligation (e.g., general orders with advance payment, guaranteed booking, or vouchers) without physically presenting it (e.g., by phone, internet, etc.), the Contractual Partner is not entitled, vis-à-vis FUNCKYHOME, to revoke this charge with their credit card institution.

§ 5 Cancellation / reduction of benefits

Reservations by the Contractual Partner are binding for both parties upon acceptance by FUNCKYHOME. In the event of cancellation or reduction by the Contractual Partner, unless otherwise agreed, the following compensation for damages must be paid: No compensation if the written cancellation or reduction reaches FUNCKYHOME by the contractually agreed time before the start of the service period. Compensation in the amount of 100% of the value of the ordered services for all booked nights if the written cancellation or reduction reaches FUNCKYHOME less than the contractually agreed time before the start of the service period. In the case of cancellation on the arrival day or no-show, 100% is charged for the 1st night and 100% of the accommodation price for each booked subsequent night. In case of no-show, the claim to booked subsequent nights expires. If apartments were booked individually by the same booker for the same period, FUNCKYHOME is also entitled to subsequently enforce separate cancellation deadlines. Up to 30 days before arrival, you can cancel free of charge. In the event of cancellation within 30 days before arrival, you pay an amount equal to 50% of the total price. 7 days before arrival, you pay an amount equal to 75%. In case of no-show on the arrival day by 10:00 PM, you pay the full price.

§ 6 resignation / termination

FUNCKYHOME is entitled to withdraw from the contract (§ 323 BGB) or terminate the contract (§ 314 BGB) in accordance with statutory provisions if: the Contractual Partner fails to provide a due service; fulfillment of the contract is impossible due to force majeure, strike, or other circumstances not attributable to FUNCKYHOME; the Contractual Partner makes misleading or false statements about essential data; the Contractual Partner uses the names "FUNCKYHOME" / "FUNCKYHO.ME" / "funckyhome" / "funckyho.me" in advertising measures without prior written consent; contractual premises are sublet in whole or in part without FUNCKYHOME's written consent; FUNCKYHOME has reasonable grounds to believe that the use of the service may endanger the smooth business operations, security, or public reputation of FUNCKYHOME. FUNCKYHOME is further entitled to terminate the contract immediately (§ 543 BGB) if the Contractual Partner or their companions: a) Willfully damage or destroy the apartments or inventory; b) Significantly disturb the peace of the house, harass other guests, or engage in illegal activities; c) Repeatedly violate house rules (e.g., smoking ban, pet regulations). In such cases, the Contractual Partner must vacate the apartments immediately. FUNCKYHOME retains the claim to the full rental price and is not liable for refunds. The Contractual Partner is liable for all damages incurred, cleaning and repair costs, as well as revenue losses. FUNCKYHOME may involve authorities (e.g., police) if necessary.

§ 7 Technical facilities and connections

The guest is liable for damages caused by electronic devices brought by them. Liability of FUNCKYHOME for damages to the guest caused by electronic devices brought by them is excluded. To the extent that FUNCKYHOME procures technical and other facilities from third parties on behalf of and at the request of the guest, it acts in the name, with authorization, and on the account of the guest. The guest is liable for careful handling and proper return. They indemnify FUNCKYHOME from all third-party claims arising from the provision of these facilities. The use of the guest's own electrical appliances using FUNCKYHOME's power network requires its consent. Disruptions or damages to FUNCKYHOME's technical facilities caused by the use of these devices are borne by the guest, and the guest is liable for them, insofar as FUNCKYHOME is not responsible. FUNCKYHOME may record and charge the electricity costs incurred through use on a flat-rate basis. Disruptions to technical or other facilities provided by FUNCKYHOME, such as INTERNET-WLAN/LAN, will be rectified as soon as possible. Payments cannot be withheld or reduced insofar as FUNCKYHOME is not responsible for these disruptions.

§ 8 Liability of FUNCKYHOME

FUNCKYHOME is liable for damages resulting from injury to life, body, or health based on intentional or negligent breach of duty. Otherwise, FUNCKYHOME is liable only for intent and gross negligence. This also applies to vicarious agents. Liability for items brought by the Contractual Partner is limited to one hundred times the accommodation price, but at most €3,500 (§ 702 BGB). FUNCKYHOME recommends taking out travel insurance.

§ 10 Final Provisions
Should individual provisions of these GTC be invalid or unenforceable or become so, the validity of the remaining provisions remains unaffected. The parties undertake to replace the invalid provision with a valid one that comes closest to the economic purpose. Place of performance and jurisdiction is, insofar as legally permissible, the registered office of FUNCKYHOME (Local Court Eutin). German law applies.
